Judge throws out Ashley Stewart Chapter 11 filing
Ashley Stewart’s attempted Chapter 11 is off the table for now after the U.S. Bankruptcy Court for the District of New Jersey dismissed the Dec. 17 filing on Dec. 29 because it was made “without proper corporate authority,” according to Retail TouchPoints. The filing had been authorized by a “newly reconstituted board” seeking to challenge a November 2025 foreclosure-sale transaction involving G Ashley Inc., which the filers alleged was controlled by former insider management.
The immediate practical consequence is that Ashley Stewart loses the breathing room of the automatic stay while the corporate-control fight continues outside bankruptcy. Retail TouchPoints reported that stores and the website remained open, but creditors are free to pursue claims without Chapter 11 protections, making this a high-leverage development for lenders, trade creditors, landlords, and potential buyers tracking whether the retailer reorganizes, liquidates, or returns to court with proper authorization.
