Vertex Energy is in post-effective-date administration: its chapter 11 plan has been confirmed and implemented, while the Vertex GUC Trust continues reconciling general unsecured claims and the reorganized enterprise works toward closing the remaining cases. The latest Bango Oil post-confirmation reportDkt. 122 states that the plan became effective on January 21, 2025 and that Bango Oil anticipates seeking a final decree by December 31, 2026.
Vertex and its affiliates filed chapter 11 on September 24, 2024 after a renewable-diesel expansion at the Mobile refinery encountered execution delays, cost overruns and production below expectations, while weaker renewable-fuel economics, declining conventional refining margins and growing Renewable Fuel Standard obligations tightened liquidity. The debtors entered bankruptcy with approximately $422.5 million of funded obligations, led by a $271.9 million term loan and a $111.2 million Macquarie intermediation facility, after prepetition marketing efforts failed to produce a viable transaction. They had support from all term-loan lenders and sought a $280 million DIP facility, including $80 million of new money, to fund operations and a compressed restructuring process, as detailed in the CRO declarationDkt. 18.
That process culminated in entry of the plan confirmation orderDkt. 578 on December 20, 2024. The remaining work is principally claims administration. In July 2026, the GUC Trust reported approximately $914.7 million of asserted general unsecured claims across roughly 530 proofs of claim and 635 scheduled claims, with prior claim-reduction efforts completed and further objections under review, in its deadline-extension motionDkt. 119. A separate superseded-claims noticeDkt. 118 identified 89 scheduled claims displaced by filed proofs of claim and set an August 13, 2026 response deadline. The court then extended the claims-objection deadline to January 11, 2027Dkt. 120, leaving claim reconciliation—not confirmation or operating financing—as the principal remaining case milestone.
