Court increases DIP facility to $6.0 million
The court approved Coking Coal’s DIP amendment with Tacora Capital LP, increasing the authorized borrowing cap from $4.5 million to $6.019 million under the postpetition non-revolving credit facility. The order leaves the rest of the final DIP framework intact, including cash-collateral and adequate-protection provisions, but authorizes additional draws under the amended budget attached to the order. The timing matters: the court first granted same-day shortened notice for the DIP amendment hearing, then entered the substantive financing order, compressing the process for incremental liquidity into a single April 17 hearing cycle.
