Apatang’s legal counsel Brendan Layde told senators during a Senate Standing Committee on Gaming meeting last Dec. 11 on Capitol Hill—removing a major legal uncertainty and clearing the way for the governor's push to end exclusivity and allow multiple casino operators.
“The principal of Team King has already sent a letter to the governor and lieutenant governor, stating that Team King will not be exercising the option to acquire the exclusive license. And instead, might potentially be interested in seeking a non-exclusive license after amendments are made to the legislation, which was the communication the governor sent to the Legislature,” Layde said.
Layde also said Team King's written notification has already been filed in federal bankruptcy court. The company purchased Imperial Pacific International (CNMI) LLC's assets last August, including a nine-month option to take over the monopoly license, but has apparently now formally declined to exercise it.
The administration’s senior policy adviser, Clyde Norita, also confirmed plans to restore and reconstitute the Commonwealth Casino Commission if lawmakers adopt the governor's casino reform bill. Casino oversight is currently housed under the Lottery Commission due to a 2025 executive order.
Norita said the administration is prepared to rescind the executive order abolishing the casino commission as soon as a revised casino law is enacted.
"I think it goes hand in hand with the legislation. The administration has concerns with the previous law. The way the Casino Commission was organized. I think when the legislation is passed, before signing to law that the executive order has to be rescinded. I mean, you can't have multiple commissions trying to fight over who's got jurisdiction,” he said
Committee chair Sen. Corina Magofna agreed the Lottery Commission's structure—led by three agency heads who already run their own departments—is not suited to regulate several casino operators.

This was disclosed during a status hearing today presided over by CNMI designated bankruptcy judge Robert J. Faris at the U.S. District Court of the Northern Marianas.
Faris presided over the Chapter 11 bankruptcy hearing, with appearances from attorneys representing Hong Kong-based IPI, Team King, the creditor committees, secured creditors, and government agencies in the CNMI.
With the sale’s closure, Faris discharged his order of show cause on the Chapter 11 bankruptcy filing of IPI.

DeLeon Guerrero expressed deep frustration during a board meeting last May 29 over the continued absence of legal representation from the Office of the Attorney General, warning that the situation leaves the CCC vulnerable as the sale of Imperial Pacific International (CNMI) LLC’s assets to Team King Investment moves forward in federal court.
“This is very discouraging,” said DeLeon Guerrero at the CCC's monthly board meeting at Springs Plaza. “When you hear that your own legal counsel is really not giving you proper legal advice, it’s disheartening. If I had a choice and I were a private entity, I’d fire the lawyer.”
For the second straight month, no attorney from the OAG attended the CCC meeting despite repeated requests. DeLeon Guerrero said he had submitted a formal letter on May 20 to Attorney General Edward Manibusan requesting clarification on several implications of a May 1, 2025 federal order approving Team King Investment as the winning bidder in IPI’s bankruptcy auction.
The CCC chair emphasized that the commission, by law, depends on the AG’s office for legal counsel—especially critical now that Team King has until June 12, 2025 to fulfill conditions of the purchase. DeLeon Guerrero said the CCC must begin preparing to conduct due diligence on the potential new casino operator but is being told to wait until the sale is finalized.
“Right now, the casino license is being tossed up in the air to be transferred from one entity to another. Guess who's going to do the due diligence? The CCC. And we cannot come in the 11th hour—we must be on top of this process,” he said.
“If Tim King wants to assume [IPI’s obligations] and obtain the license, we need to discuss how they plan to pay that $20 million,” Deleon Guerrero said. “The AG’s office has not clarified what the cure amount is, if any, and that’s unacceptable.”

Faris has approved the sale of Imperial Pacific International (CNMI) LLC's casino properties to Team King Investments, marking a major milestone in the Chapter 11 bankruptcy case even as CNMI officials pledge to continue monitoring the situation.
The ruling, issued last Tuesday, April 29, at the U.S. District Court of the NMI, authorizes the asset sale and related stipulations after more than a year of proceedings to resolve the Saipan casino’s extensive debt obligations.
Faris presided over the Chapter 11 bankruptcy hearing, with appearances from attorneys representing Hong Kong-based IPI, Team King, the creditor committees, secured creditors, and government agencies in the CNMI.
He approved the sale, describing it as "not the best, but the least bad outcome" under the challenging circumstances.
Assistant Attorney General Robert Glass, appearing for the Office of the Attorney General, said the sale marks an important step for the Commonwealth.
"This case has been challenging, but the sale ensures at least partial recovery for the Commonwealth and creditors," Glass, in an interview outside the district court, said the sale to Team King Investments was a compromise.

Yesterday, the Commonwealth Casino Commission held a board meeting to discuss updates on IPI’s Chapter 11 Bankruptcy petition.
IPI director Howyo Chi appeared before the commission and informed them that IPI gained a small win yesterday during its bankruptcy hearing before U.S. District Court for the NMI Chief Judge Ramona Manglona after she approved IPI’s DIP financing request and approved an interim withdrawal of $400,000 from a $7-million loan IPI recently secured.

This, after embattled Imperial Pacific International (CNMI) LLC and the official committee of general unsecured creditors selected Team King Investment’s $12.95 million bid in a Feb. 26 auction to liquidate IPI’s casino property.
The second best bid of $12.5 million by Loi Lam Sit is the back-up bidder for the casino assets, based on a Feb. 27 filing at the U.S. District Court for the NMI’s Bankruptcy Division by Imperial Pacific and the official committee of general unsecured creditors.
The bids of both Team King Investment and Loi Lam Sit include an option to buy Imperial Pacific's casino license and assumption of certain liabilities of the Hong Kong-based casino investor.
The Bankruptcy Division also set a 9 a.m. March 25 hearing before Bankruptcy Judge Robert J. Faris to consider the approval of the casino property sale, free and clear of all liens, claims, and encumbrances.
The Feb. 26, 2025 auction includes Imperial Pacific's primary real estate assets that include a hotel building currently under construction with a casino.
It also includes a leasehold interest in approximately 19,204 square meters of land leased from the CNMI Department of Public Lands, and IPI’s ownership interest in Imperial Pacific Properties LLC, which holds a leasehold interest in eight lots adjacent to the leasehold property.
