Court confirms Avenger Flight Group liquidation plan
The court confirmed Avenger Flight Group's combined disclosure statement and first amended Chapter 11 liquidation plan at the June 23 confirmation hearing, moving the case into a post-confirmation liquidation posture rather than continued plan litigation. The confirmation order approves final disclosure-statement treatment, confirms the plan over deemed rejections by Classes 7 and 8, and leaves the effective date to occur once plan conditions are satisfied or waived.
The order also sets the wind-down architecture professionals will now track: litigation trust assets vest in a Litigation Trust on the effective date, Peter Hurwitz of Burton Hastings Advisors LLC becomes Litigation Trustee, and retained estate causes of action transfer to the trust unless expressly released or waived. Final professional fee applications are due within 45 days after the effective date, so the next economically relevant markers are the effective-date notice, trust funding, claims reconciliation, and any litigation-trust recoveries that drive creditor distributions.
