Court approves contract rejections as Barkley Solar dispute continues
The court authorized Vanderbilt Minerals to reject ground leases with Clearwater Solar, Earls Solar and Harley Solar effective June 11, 2026, and its Jungbunzlauer distribution agreement effective June 24. The approved schedule derives from the debtor’s amended rejection exhibits, and the court entered the rejection order following the July 15 hearing.
Barkley Solar’s separate ground lease was excluded and continued to August 19. Barkley has elected under section 365(h) to remain in possession of 486 acres in Moore County, North Carolina, for the lease term and any extensions, while preserving renewal, assignment and rent-offset rights. Its limited objection does not oppose rejection as a breach but seeks an order confirming that rejection cannot terminate its leasehold. Vanderbilt therefore sheds four agreements now, but the estate’s ability to recover or redeploy the Barkley property remains constrained pending resolution of the tenant’s statutory rights.
