Navidea liquidation plan goes effective
Navidea’s Subchapter V liquidation plan became effective on June 11, moving the case from sale/confirmation into post-effective-date administration. The Notice of Plan Effective Date ties effectiveness to the May 27 confirmation order and says the debtor made the required effective-date payments to Mr. Scott, Fox Rothschild LLP, and Winstead PC; it also makes July 13, 2026 the bar date for administrative expense requests and final professional fee applications.
The practical shift is that remaining value now runs through plan implementation rather than the Cardinal Health sale itself. Under the Second Amended Subchapter V Liquidation Plan, plan funding comes from remaining sale proceeds, Shareholders’ Bankruptcy Action proceeds, and Litigation Trust distributable proceeds; a Plan Administrator handles claims reconciliation and distributions, while a Litigation Trustee evaluates and pursues litigation trust actions. The Plan Confirmation Order appointed Edward Burr as Plan Administrator and approved the plan’s release, exculpation, and injunction framework, including opt-in third-party releases for Class 2 creditors.
