Brayman Precast is pursuing a Subchapter V liquidation plan that would fund creditor distributions through asset sales, available cash, possible settlements and insurance interests. The court has scheduled a November 4, 2026 hearing on the debtor’s request for expedited consideration of its proposed mediation protocol for collapse-related claims; it has also requested expedited consideration of plan solicitation and confirmation procedures. Hearing order Dkt. 293
Brayman Precast is pursuing a Subchapter V liquidation under its October 22, 2026 plan Dkt. 273. The proposal would use asset sales, available cash, possible settlements and insurance interests to fund distributions, with a plan administrator liquidating remaining assets, resolving claims and winding down the company. A global settlement is not a condition of feasibility under the proposal; absent one, incident-related claims would proceed through the plan’s claims process.
The Pennsylvania precast concrete manufacturer filed for Chapter 11 on July 24, 2026. Its first-day declaration Dkt. 19 attributes the filing to the April 8 collapse of a parking garage connected with a Children’s Hospital of Philadelphia project, in which three construction workers died. The debtor reported threatened litigation, investigation costs, reduced contract awards and liquidity pressure, after evaluating financing, sale and restructuring alternatives outside bankruptcy.
The court’s final financing order Dkt. 179 authorized up to $2.5 million in debtor-in-possession financing and use of cash collateral under an approved budget. Of the commitment, $800,000 had been borrowed under the interim order and another $1.7 million became available under the final order. The order set milestones of November 16, 2026 for an asset-transfer closing and, absent an asset transfer through a confirmed acceptable plan, November 25 for confirmation of an acceptable plan.
Claims arising from the collapse remain central to the proposed liquidation. The debtor has requested approval of a voluntary mediation protocol Dkt. 292, and the court scheduled a November 4 hearing Dkt. 293 on the request for expedited consideration. Separately, creditor High Concrete Group has asked the court to estimate eleven unliquidated claims Dkt. 277, citing their potential effect on plan feasibility and competing claims to insurance proceeds. The debtor has also requested expedited consideration of proposed solicitation and confirmation procedures Dkt. 294; those procedures remain requests.
