Comcar Industries’ Chapter 11 case closed on January 24, 2025, under the final decree Dkt. 2001, following its liquidation plan and trust administration. The decree made completion of final distributions and payment of statutory fees prerequisites to trustee discharge and required final reporting through closure.
The court closed Comcar Industries, Inc.’s Chapter 11 case and seven affiliated cases on January 24, 2025, through the final decree Dkt. 2001, which also terminated claims and noticing services. Trustee discharge was conditioned on completing final distributions and paying all statutory fees; the decree also required a final post-confirmation report covering the period through closure.
Comcar filed Chapter 11 on May 17, 2020, to pursue going-concern sales of its trucking businesses. The first-day declaration Dkt. 22 described a trucking downturn, revenue declines across its four operating divisions, losses of $25 million in 2019 and a further $6 million through March 2020, and a prepetition marketing process that produced proposed buyers for the CT and CTL businesses. The court authorized postpetition financing and use of cash collateral in the July 2, 2020 final DIP order Dkt. 370.
The court confirmed the liquidation plan on March 11, 2021, through the confirmation order Dkt. 1272. The trustees’ January 6, 2025 final-decree motion Dkt. 1996 reported that the plan reached effectiveness on April 30, 2021, and that the estates were fully administered and the plan substantially consummated. It also reported approval on June 28, 2024, of a final pro rata distribution of approximately 5% to Class 4 general unsecured claims.
A late-stage recovery came from the settlement with ACE American Insurance Company, or Chubb, approved by the November 7, 2024 settlement order Dkt. 1994. The final-decree motion Dkt. 1996 reported that, as of December 6, 2024, Chubb had paid $2,681,290.00 to the Wind-Down Trust and $23,408.96 to the Liquidating Trust. Those payments preceded the trustees’ request for closure and the January 24, 2025 decree.
