EHT US1, Inc.’s Chapter 11 case closed on March 23, 2023 under the final decree Dkt. 2435. The restructuring followed a liquidation path, with the December 28, 2021 effectiveness notice Dkt. 1930 reporting that the liquidation plans became effective and were substantially consummated that day.
EHT US1, Inc.’s Chapter 11 case closed on March 23, 2023, when the court entered the final decree Dkt. 2435 closing its case and the remaining listed Chapter 11 cases. The proceeding began on January 18, 2021 and followed an asset-sale and liquidation strategy.
EHT US1 was part of Singapore-based Eagle Hospitality’s U.S. hotel ownership structure, whose portfolio comprised 18 full-service hotels. In the January 19, 2021 first-day declaration Dkt. 13, Chief Restructuring Officer Alan Tantleff attributed the distress to defaults by Urban Commons-controlled master lessees that began before the pandemic and triggered acceleration of the prepetition credit facility. Most hotels had closed by May 2020. The group terminated the master leases effective October 1, 2020 and had recovered legal control of eleven hotels by the petition date; rejection of proposed restructuring resolutions at a December 30, 2020 shareholder meeting preceded the bankruptcy filing.
The court’s February 24, 2021 final DIP order Dkt. 287 authorized a senior secured, superpriority delayed-draw facility with commitments of up to $100 million to support the bankruptcy process. The November 1, 2021 amended liquidation plan Dkt. 1525 subsequently reported $481.9 million in aggregate gross hotel-sale proceeds and provided for a liquidating trust to administer remaining assets, reconcile claims, pursue retained causes of action and make creditor distributions.
The December 28, 2021 effectiveness notice Dkt. 1930 reported confirmation of the modified liquidation plans on December 20, 2021 and their effectiveness and substantial consummation on December 28, identifying Tantleff as liquidating trustee. The case thus moved from hotel-asset sales to trust administration and estate wind-down before the March 2023 closure.
