GWG Wind Down Trust is administering the post-confirmation wind-down of GWG Holdings and its affiliated debtors. The court confirmed their plan on June 20, 2023, and the plan became effective on August 1, 2023, as reflected in the effective-date notice Dkt. 2079.
The latest material step is the court’s October 14, 2026 approval of the amended joint prosecution and allocation agreement with Beneficient Dkt. 2965. The agreement provides for information sharing in investigations of alleged wrongdoing by Brad Heppner and related entities, and calls for Beneficient to furnish the Litigation Trust any monetary recoveries from claims against Heppner. The Litigation Trustee retains independent business judgment. The next phase is pursuit of those matters under the approved agreement.
In the September 2026 quarterly report for GWG Holdings Dkt. 2959, successor trustee Tom Howley reported $468,581 in cash disbursements for the quarter and $70,882,320 cumulatively since plan effectiveness. Those figures are disbursements reported for GWG Holdings and do not establish creditor recoveries across the cases.
GWG Holdings filed chapter 11 on April 20, 2022, after liquidity pressures associated with SEC investigations and disruption to bond sales and financial reporting; it had defaulted on bond payments in January 2022. Its first-day declaration Dkt. 17 described a life insurance policy portfolio and substantial bond obligations. Identified prepetition debt across five instruments was approximately $2,012,708,310, including debt not limited to the original debtors; the identified amounts draw on different dates in 2022. The DLP affiliates that held policy assets filed on October 31, 2022, amid competing options for the portfolio, as described in their first-day declaration Dkt. 974.
