Magnum reached Chapter 11 plan effectiveness, reported in its effective-date notice Dkt. 740 filed December 31, 2019. The next recorded procedural step was post-confirmation review: the court's January 16, 2020 order Dkt. 765 vacated the amended confirmation order entered that day and reset the post-confirmation status conference.
Magnum Construction Management, LLC's March 1, 2019 Chapter 11 proceeding reached plan effectiveness, which the debtor reported in its notice concerning the Third Amended Plan Dkt. 740 filed December 31, 2019. The latest procedural development was the court's January 16, 2020 order Dkt. 765, which vacated the amended confirmation order at Dkt. 761 and reset the post-confirmation status conference. The case had therefore moved from financing the restructuring to post-confirmation administration.
The heavy civil contractor, formerly known as Munilla Construction Management, filed after the Florida International University pedestrian bridge collapse. Its first-day CFO declaration Dkt. 8 described liquidity pressure, a workforce reduced from a peak of 720 to 292 employees, and annual general and administrative expenses cut from $12.6 million to approximately $4.8 million. Another operating setback was the Texas Department of Transportation's January 25, 2019 termination of the $35 million FM 2181 contract; Magnum disputed the termination as wrongful, citing utility conflicts and scheduling issues.
The restructuring relied on financing from the contractor's surety providers, Travelers and Berkshire Hathaway Specialty Insurance Company. The August 28, 2019 Berkshire final financing order Dkt. 439 authorized borrowing up to $3,000,000.00, while the same day's Travelers final financing order Dkt. 444 authorized borrowing up to $23,300,000; both also authorized cash-collateral use. These were borrowing authorizations, rather than amounts established as drawn. The court also authorized an equipment auction and online sale through its April 26, 2019 sale order Dkt. 206, providing an asset-disposition component alongside the debtor's reorganization path.
