Tijuana Flats Restaurants, LLC’s Chapter 11 case, filed April 19, 2024, closed on March 27, 2025, under the final decree Dkt. 867, which found the confirmed reorganization plan substantially consummated and denied unresolved motions, objections and applications as moot. The court had confirmed the joint reorganization plan Dkt. 738 on January 17, 2025. The debtors’ notice of effectiveness and substantial consummation Dkt. 861 fixed both milestones at March 18, 2025.
The Florida Tex-Mex restaurant operator entered Chapter 11 to address accumulated accounts payable and tax obligations while preserving its business. Its April 19, 2024 cash-collateral motion Dkt. 13 attributed the distress to interest-reserve payments, menu-related operating costs, rising food and labor costs, and compressed margins. The filing followed the closure of 11 unprofitable locations; the debtor sought liquidity to maintain operations across 65 restaurants while pursuing reorganization or a going-concern sale.
Operations during Chapter 11 depended on access to secured lender LSC2022, LLC’s cash collateral. The August 15, 2024 final cash-collateral order Dkt. 350 authorized its continued use for ordinary-course and court-approved expenses, with a replacement lien limited to diminution in collateral value, a superpriority adequate-protection claim and a $200,000 professional-fee carve-out. The court also approved a postpetition credit agreement with US Foods Dkt. 291 on July 18, 2024.
Creditor distributions were implemented through amended schedules. The amended distribution motion Dkt. 837 provided $200,000.00 for Class 2 general unsecured claims against Tijuana Flats Restaurants totaling $6,268,682.11, and $5,000.00 for Class 3 claims against Tijuana Flats #176, LLC totaling $3,353,519.46. The March 13, 2025 approval order Dkt. 857 corrected the omission of LSC2022’s deficiency claim. In their March 18 final-decree motion Dkt. 862, the debtors reported that all amounts due to those unsecured classes had been distributed and necessary operating contracts and leases assumed. Ordinary-course liabilities, statutory fees and priority tax claims were reported paid in full or being paid under the plan.
